Agreement to our terms
By using our services and/or tools as a consumer, you automatically agree to the conditions below. We therefore recommend that you read the conditions below carefully.
Disputes and disputes
As an independent organization, we are there for both the online retailer and the consumer. We mediate in disputes without taking sides. To do this properly, we ask you:
• To communicate in a decent and mature manner with all parties involved.
• No inaccuracies or half-truths to tell. We can help you best when we are aware of all the facts.
• Send us the requested information or supporting documents, without proof we will in many cases not be able to check your side of the story.
• To indicate what, in your opinion, is a solution to the dispute. We want to avoid long principled discussions without solutions.
• Respond quickly so that we can quickly find a solution.
Write reviews
We believe it is important that our customer reviews provide the best possible picture of the performance of an online store. That is why we have a fixed policy that must guarantee the authenticity of the reviews.
Rules for reviews
You are responsible for the content of your review and for providing correct and complete information. We refuse a review if:
• This contains inappropriate language. This primarily concerns swearing and cursing or other expressions that are experienced as insulting, discriminatory, objectionable or inappropriate in the context.
• This contains factual untruths or inaccuracies. We do not judge feelings or opinions. For example, a delivery time of 3 days may be perceived as fast by one consumer and slow by another. However, a statement such as “the delivery time was much longer than indicated” can be tested by comparing the indicated delivery time with the actual delivery time. WebwinkelKeur therefore only tests facts and not feelings.
• This contains unnecessary references to competitors.
• If the reviewer does not cooperate in checking the review. For example, an online store may indicate that a review is incorrect. We will then contact the reviewer to check the authenticity of the review through a hearing. If the assessor does not cooperate, we will give the online store the benefit of the doubt.
• If the (delivery of the) order was placed more than 6 months ago. We think it is important that the review provides an up-to-date picture of the customer service of the online store. It is also difficult for us to check the facts in a long-term conflict.
• If you have not demonstrably been a customer of the relevant (online) store. It is not the intention to post reviews on behalf of third parties, or reviews of purchases made via third-party websites.
• The review is only a response to a previous review. The rating option is not intended as a response to another or previous review. It is always possible to supplement your previous experience via the link that you receive from us by email after placement.
• The review contains personal data of a third party or data leading to a third party. We are legally not allowed to publish this information.
• This is (unnecessarily) too long. (Max. 600 characters)
• A review is written in exchange for a product (to test), money or a discount.
• This is contrary to the law in some other way.
Reviews in quarantine
If the review is disputed by the online retailer, we will start an investigation. We are quarantining the review during our investigation.
If we have reason to believe that a review is incorrect or unjustified, we will quarantine the review and start an investigation.
We will make every effort to complete the investigation as quickly as possible and republish or remove the review.
Placement of the review
After placement, you grant WebwinkelKeur the right to publish and reproduce the review. This right is perpetual, unlimited and irrevocable. WebwinkelKeur is not obliged to pay any compensation for this.
Basis for collecting personal data
The invitation email to leave a review
To inform customers about the quality of the online store, online stores can invite customers to leave a review. We will then send an email to you on behalf of the online store and then publish the review. This can be done through settings, via our email address or an email address chosen by the webshop. We process the following personal data to send the invitation: your name, e-mail address and order number. Optionally, we can also process the telephone number and ordered products, for example to send a mobile invitation and/or collect product reviews.
The webshop is obliged to inform you that it shares personal data with WebwinkelKeur for sending the invitations. We consider the risk of processing these personal data to be average. Invitations are sent via email (partner: Mandrill). We store this data on a secure database, the server is in the Netherlands and a secure backup is in Switzerland. We keep this data for three years. We consider this necessary to provide the online store with statistics about the invitations sent and to prevent a single consumer from writing multiple reviews. In this way we try to protect the webshop from reviews that can be written by their competitors.
The review itself
We publish reviews about an online store submitted by their customers on their own member page. If a remarkable or offensive review has been left, an online store can ask us to adjust or remove the review through a moderation request. If the online store does this, in most cases we will contact the person who left the review on their behalf.
To publish and manage the review, we process the following personal data: the review text, your name, IP address and email address. Optionally, the telephone number and ordered products can also be processed. You will be asked for an order number, but it is not mandatory to enter it. You give us permission to process and publish the above personal data when submitting your review.
We consider the risk of processing these personal data to be average. Correspondence is sent via email (partners: Mandrill & SupportBee). We store this data on a secure database, the server is in the Netherlands and a secure backup is in Switzerland.
We store this data indefinitely. We consider this necessary from the point of view of providing information to you as a consumer about the reliability of an online store. We can remove the review at your request. You can always edit or delete your review yourself.
